1. Agreement

By accessing or using this website (“Site”), you agree to these Terms of Use. If you do not agree, do not use the Site. EcoValley Animal Sanctuary (“EcoValley,” “we,” “us,” or “our”) may change these terms at any time by posting an updated version; continued use after changes means you accept the new terms.

2. Intellectual property

Unless otherwise noted, all content on this Site, including text, photographs, graphics, logos, page layout, stories, animal profiles, and other materials, is owned by EcoValley Animal Sanctuary or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view and print pages for personal, non-commercial use. You may not, without our prior written permission: copy, reproduce, republish, upload, post, transmit, sell, license, scrape, frame, mirror, or distribute Site content for commercial purposes; use our name, logo, or branding in a way that implies endorsement of another product or organization; or create derivative works from our content.

Sharing links to our pages on social media or by email is welcome. Embedding or hotlinking our images or media on other sites in a way that suggests we sponsor or control that site is not allowed without permission.

3. Acceptable use

You agree not to: use the Site unlawfully or in a way that harms EcoValley, our animals, volunteers, or third parties; attempt to gain unauthorized access to our systems or data; transmit malware or spam; misrepresent your identity or affiliation; or use automated means (bots, scrapers) to harvest content at scale without permission.

4. Information on the Site

We strive for accuracy, but information on the Site is provided for general purposes only. Animal availability, programs, hours, and policies may change. Nothing on the Site is veterinary, legal, or financial advice. Visits and animal interactions are subject to separate rules and scheduling; the Site does not guarantee access to property or animals.

5. Donations

Donations made through links on this Site are processed by third-party payment providers (e.g., Stripe). Those transactions are subject to the provider’s terms and privacy policy. EcoValley is working toward nonprofit status; unless and until we notify you otherwise, donations are not tax-deductible. Nothing on the Site constitutes tax or legal advice about deductibility. See our donation disclosure.

6. Third-party links

The Site may link to Instagram, payment processors, or other sites. We are not responsible for third-party content or practices. Use of those services is at your own risk.

7. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ECOVALLEY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EcoValley Animal Sanctuary and its operators, volunteers, and representatives SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE PROHIBITED BY LAW.

9. Indemnification

You agree to defend, indemnify, and hold harmless EcoValley Animal Sanctuary and its representatives from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any third-party rights.

10. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. You agree that courts in Texas shall have exclusive jurisdiction over disputes arising from these Terms or the Site, subject to any contrary requirement of law.

11. Severability

If any provision is held invalid, the remaining provisions remain in effect.
